FAIR HOUSING
ISSUE BRIEF

ISSUE:    The systematic approach of eliminating bias in the housing industry through various laws and regulations placed upon those who are involved in the creation and transfer of real property.

BACKGROUND:    Delaware has well established laws in the fair housing arena that most argue have effectively dealt with bias against buyers and renters of real property. Fair housing policies are often tested by the Department of Housing and Urban Development (HUD) and other federal and state agencies to ensure that brokers, builders and landlords are following fair housing laws.

DAR POLICY:    DAR supports fair housing. As part of DAR's agreement with the National Association of REALTORS®, our members subscribe to a strict code of ethics that includes representing all buyers justly and fairly as they pursue their choice of housing in Delaware and continued fair housing education. Finally, during the last significant re-write of the state's fair housing laws, some ten years ago, DAR's Chief Counsel, then and now, was one of the prime drafters of the legislation. DAR believes that fair housing must be tested and affirmed to ensure that all citizens of the state have an equal opportunity to pursue their idea of the American Dream.

IMPACT:    It is clear among DAR's members statewide that violating the state's fair housing laws can bring significant legal ramifications to them as individual REALTORS® and to our association generally.

STATUS:    Currently there is no legislation pending to amend the Fair Housing Act.
